Acevedo reinstates fired officer

Austin Police Chief Art Acevedo on Monday reinstated a sergeant he fired last year amid allegations that the officer repeatedly sexually harassed a police employee and lied to internal affairs investigators. Sgt. Dustin Lee will be demoted to detective and will not receive any back pay for the salary he has lost since his firing in May, attorney Tom Stribling said.

Stribling said that Lee was appealing the termination and that he and Acevedo had been discussing a compromise. “We feel like we came out with a fair agreement,” Stribling said.

According to a disciplinary memo, Lee made comments about how the employee was dressed and asked her if she had sex on a recent vacation. The memo said that several officers confronted Lee about his comments but that he told internal affairs detectives that no one had.

Lee also interfered with the internal investigation by asking a witness why she was talking to detectives, the memo said. Lee is the second officer Acevedo has reinstated in recent months.

Officer Aaron York returned to the force in October after Acevedo changed the findings to “inconclusive” in an internal affairs investigation that reviewed whether York had tampered with a government record and was dishonest. However, Acevedo sustained charges that York had engaged in insubordination and did not appropriately complete reports. Acevedo said in a one-page memo that York, who was fired in June, also would not be given back pay for the time he was out of work.

so they get fired as their punishment for their offense yet they end up getting their job back because the guy whined to the civil service commission that he didn’t do anything wrong…of course APD officers do no wrong….
